Triple Talaq by Email Amounts to Mental Torture: Patna High Court

The case involved allegations from the wife that her husband issued triple talaq in 2014 via email, following months of dowry demands and neglect.

The Patna High Court rejected a husband's plea to quash charges under Section 498A IPC and the Dowry Prohibition Act,1961 applying the Supreme Court’s 2017 ruling in Shayara Bano on triple talaq. The Court also ruled that giving triple talaq via email constitutes mental torture.

The Court criticized the misuse of triple talaq, emphasizing its violation of personal rights and constitutional protections under Article 14 and Article 21, and stressed the need for prior conciliation.
