Unmarried Adult Parents Can Live Together, Allahabad High Court Upholds Right to Cohabit

  • Case Name: X v. State of U.P. and 7 Ors.

The Allahabad High Court granted police protection to an interfaith live-in couple, observing that unmarried adults have the constitutional right to live together.

A court passed the order while hearing a plea by the couple’s minor daughter, who claimed threats from the mother’s former in-laws.

The Court noted that the couple, from different religions, had lived together since 2018 and had a child in 2023. After the woman’s husband died, she began living with the child’s biological father.

The Court held that the major parents are entitled to live together, even if they have not undergone marriage. The Court directed the police to register an FIR, and the writ petition was allowed.
