UP Government to Revise Guidelines for Gangster Law After SC Raises Concerns

  • Case Name: Gorakh Nath Mishra v. State of Uttar Pradesh
  • Judge(s): Justices Surya Kant and Ujjal Bhuyan
  • Advocate(s): K M Nataraj

The Uttar Pradesh government told the Supreme Court that new guidelines for the Uttar Pradesh Gangsters and Anti-Social Activities (Prevention) Act, 1986, are almost ready. This follows the Court's concerns about the law's draconian provisions. The government will also review current cases to determine if the law is applicable and suitable.

Additional Solicitor General K M Nataraj confirmed the new guidelines and existing cases will be reconsidered. The Court set the next hearing for January 2025.

The Act mandates a prison term of 2 to 10 years, heavy fines, and harsher penalties for offences involving public servants.
