A Varanasi sessions court has directed a magistrate to reconsider a plea seeking registration of an FIR against Congress leader Rahul Gandhi over his remarks about the plight of the Sikh community.
The plea filed in 2024 alleged that Gandhi made an objectionable statement during his visit to the United States, claiming there is an atmosphere of insecurity among Sikhs in India.
Rejecting the plea, the magistrate held that under Section 208 BNS, offences committed abroad require prior Central government sanction for inquiry or trial in India.
This led to the revision plea before the Sessions Court. (Nageshwar Mishra & Ors v State of Uttar Pradesh & Ors)
