Verbal Clashes Between Judges and Lawyers Not Automatically Criminal Contempt: Allahabad High Court
The Allahabad High Court has clarified that heated exchanges between judges and lawyers during court proceedings do not automatically amount to criminal contempt.
The Court observed that strong verbal disagreements or tense courtroom moments are not uncommon in the justice delivery system and should not be viewed as acts lowering the authority of the judiciary unless they substantially interfere with the administration of justice.
Emphasising restraint in invoking contempt powers, the Court noted that criticism, disagreement, or emotional exchanges by advocates cannot by themselves justify contempt proceedings.
The ruling came while examining allegations arising out of a courtroom altercation between a judge and an advocate.
