Visitation Rights Of Parent Cannot Be at Cost of Child's Health & Well-Being: SC

  • Case Name: Sugirtha vs. Gowtham
  • Judge(s): Justice Vikram Nath and Justice Prasanna B. Varale

The Supreme Court has clarified a father's visitation rights, stressing that the child's health and well-being must be prioritized.

In a custody case, the Madras High Court initially granted the father visitation rights but required the mother to travel 300 km weekly for these visits. This arrangement raised concerns about the child's welfare.

The Supreme Court has now ordered that visits take place in Madurai, allowing the father to see his child every Sunday from 10 AM to 2 PM, with the mother present to ensure the child's comfort and safety.
