What is Extradition?

Extradition is the formal legal process where one country hands over an individual to another country where they are wanted for trial or have been convicted of a crime.

In India, it is governed by the Extradition Act, 1962, and based on treaties with other nations.

The process involves a formal request, judicial scrutiny, and diplomatic review. Extradition helps prevent accused persons from evading justice by crossing borders. However, safeguards apply, such as the principle of dual criminality (the act must be a crime in both countries) and exceptions for political offenses.

India currently has extradition treaties with over 40 countries.
