What is judicial review?

Judicial review is the power of courts, mainly the Supreme Court and High Courts, to examine the constitutionality and legality of laws, executive orders, and administrative actions.

This power is derived from Article 13 & 226 of the Constitution, which ensures that laws inconsistent with fundamental rights are void. Judicial review ensures that all government actions comply with constitutional provisions and protect citizens’ rights.

Courts can strike down laws or actions that violate the Constitution. Acting as a check on the legislature and executive, it maintains the balance of power.
