Plea bargaining is a legal process where the accused voluntarily agrees to plead guilty in return for a lesser sentence, reduced charges, or other benefits, subject to court approval. It is intended to ensure speedy trials, reduce case backlog, and promote restorative justice.
Under the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, which replaced the CrPC, plea bargaining is covered from Sections 289 to 303.
Plea bargaining is permitted only in cases where the punishment is less than seven years of imprisonment. However, it is not permitted in offences involving women, children, or those affecting the socio-economic condition of the country.
