Wielding Koyta, Issuing Threats is Law & Order Issue, Not Public Order: Bombay High Court

The Bombay High Court held that merely wielding a deadly weapon like a koyta and threatening people amounts to an individualistic act and does not, by itself, affect public order.

The Court observed that such conduct may create fear among specific individuals but cannot automatically be treated as prejudicial to the maintenance of public order unless it impacts the community at large. 

It clarified that for preventive detention or similar action, there must be material showing a wider disturbance of public tranquility, not just a law-and-order issue.

On this reasoning, the Court found the action against the petitioner unsustainable and granted relief.
