The Bombay High Court held that the earning status of the woman does not bar her from receiving financial support from her estranged husband.
The Court upheld an order directing the husband to pay ₹15,000 monthly maintenance, considering the wife’s income was insufficient for her standard of living.
The significant financial disparity between the husband’s and wife’s income was noted by the court, where the husband had no major financial responsibility. Meanwhile, the wife, who was living with her parents, could not do so indefinitely.
The Court stated that the wife is entitled to the same standard of living as she had in her matrimonial home and dismissed the husband's challenge to the maintenance order.
