Delhi High Court Grants Divorce to Husband, Rules Wife’s Pregnancy Does Not Nullify Cruelty

The Delhi High Court held that a wife’s pregnancy or brief reconciliation cannot erase earlier acts of cruelty. The court set aside the family court’s order and granted a divorce to a husband who alleged persistent mental cruelty since their 2016 marriage.

The Court observed that the wife’s repeated insults, threats of self-harm, refusal to cohabit, desertion without cause, and allegations of molestation against her father-in-law destroyed marital harmony. It emphasised that cruelty must be judged from the entirety of circumstances, not isolated episodes.

The Bench also held that the family court erred in treating the wife’s miscarriage as proof of a harmonious relationship.
