The Allahabad High Court recently observed that a wife exaggerating her husband’s income during maintenance proceedings does not necessarily warrant perjury action under Section 340 CrPC.
Justice Raj Beer Singh dismissed a husband's plea seeking proceedings against his wife for claiming his monthly income was ₹80,000, despite it being ₹11,000.
The Court noted that such exaggerations are common in Section 125 CrPC cases and that courts should not become tools for private vendetta.
Holding that perjury actions are only expedient when a false statement significantly impacts the administration of justice, which was not established in this pending family court matter.
