
The Kerala High Court held that a woman can seek maintenance from her son or daughter under Section 144 of the Bharatiya Nagarik Suraksha Sanhita (BNSS) if her husband is unable or unwilling to provide for her.
The Court described Section 144 as a social justice measure that ensures protection for women, children, and aged parents, in line with the constitutional principles under Articles 15(3) and 39.
The Court observed that the obligation to maintain a woman extends beyond the husband to her children, reinforcing a broader familial duty of support.
