Delhi High Court Says ‘Yatra’ Too Common for Trademark

The Delhi High Court has refused to grant an interim injunction to Yatra Online Limited in its trademark suit against Mach Conferences and Events Limited, holding that the word “Yatra” is generic and descriptive of travel services.

Justice Tejas Karia observed that no one can claim exclusivity over common words used to describe the nature of business.

Yatra had objected to Mach’s applications for “BookMyYatra” and “BookMyYatra.com,” alleging bad faith.

However, the Court ruled that “Yatra” has not acquired secondary meaning or distinctiveness and cannot be declared a well-known mark under trademark law.
