Court Has No Magic Wand; Experts Must Find Solution: Supreme Court on Delhi Air Pollution

The Supreme Court said it cannot “wave a magic wand” to fix Delhi’s air pollution and stressed that only domain experts and scientists can identify causes and solutions. 

CJI Surya Kant noted that air quality issues arise from multiple factors, and courts must avoid assuming there is a single reason. 

The Bench, also comprising Justice Joymalya Bagchi, agreed to list the matter on December 1 for regular monitoring. 

The Court also referred to earlier directions by former CJI BR Gavai to Delhi, Punjab, Haryana and Rajasthan on stubble burning, AQI monitoring, and CAQM reports while emphasising that judicial intervention has limits in tackling complex environmental crises.
