Delhi High Court Restrains Use of ‘Bharatpay’ Trademark After BharatPe Alleges Infringement

The Delhi High Court has temporarily restrained the use of the "Bharatpay" trademark, finding it phonetically and visually similar to fintech firm BharatPe's mark.

Justice Amit Bansal, in an interim order, held that Bharatpay's services, including UPI and payment solutions, are identical to BharatPe’s, making a prima facie case of trademark infringement.

The Court ordered the suspension of the domain www.bharatpay.net and the blocking of the associated mobile number.

BharatPe had issued a cease-and-desist notice, but it was ignored. The case will be heard next on September 10.
